Welcome to Vintage by Barbara.
These terms apply to all offers, orders and agreements made via the website Buy-chromos.com. By placing an order, you accept these terms. Please read them carefully before making a purchase.

Vintage by Barbara and the website Buy-chromos.com are owned by Barbara Töpper.

Article 1. Applicability

1.0 You can only order on this site if you are over 16 years of age.
1.1 All offers, orders and agreements of Vintage by Barbara are subject to these Terms and Conditions.
1.2 By accepting an offer or placing an order, you agree to the applicability of these terms.
1.3 Deviations from these terms can only be agreed in writing; all other provisions remain in force.
1.4 All rights and claims stipulated in these Terms and Conditions for Vintage by Barbara also apply to intermediaries and third parties engaged by Vintage by Barbara.

Article 2. Offers / agreements

2.1 All offers of Vintage by Barbara are non-binding. Prices may be adjusted, especially when legally required.
2.2 An agreement is only concluded after acceptance of your order by Vintage by Barbara. Orders may be refused or subject to conditions. If an order is not accepted, you will be notified within ten (10) working days.
2.3 The colours shown in product photos may differ slightly from reality.
2.4 Most products, such as chromos and lithographs, are second-hand. Signs of wear may be present. Each item is photographed; these photos are part of the description and must be carefully reviewed by the buyer. Returns for defects clearly visible on the photos will not be accepted. For questions, additional information can be requested via the contact form.
2.5 Certain chromolithographs (e.g. Liebig) may include a quality rating (“excellent” to “good”). This is a personal assessment. Photos are provided to allow you to judge the quality yourself.

Article 3. Prices and payments

3.1 Prices are listed in euros.
As this concerns occasional private sales, mainly of second-hand goods and occasionally of new items, no VAT applies and VAT invoices are not issued.

3.2 Payments must be made online, unless otherwise agreed in writing. Goods are shipped only after payment has been verified and approved by the independent payment provider. Vintage by Barbara reserves the right to refuse orders without explanation.

3.3 If prices rise between order and fulfilment, you may cancel or terminate the order within ten (10) days of notification of the increase.

Article 4. Delivery

4.1 Delivery times are indicative only. Exceeding delivery times does not entitle you to compensation or cancellation, unless the delay is unreasonable. In that case, you may cancel or terminate the order.
4.2 Delivery takes place at the address and time when the products are ready for dispatch.

Article 5. Retention of ownership

5.1 Ownership of the delivered products passes only once all amounts due have been paid. Risk transfers at the time of delivery.

Article 6. Intellectual property rights

6.1 You must fully respect all intellectual and industrial property rights attached to the delivered products.
6.2 Vintage by Barbara does not guarantee that delivered products do not infringe any intellectual property rights of third parties.

Article 7. Complaints and liability

7.1 Upon delivery, you must check whether the products conform to the agreement. If not, you must inform Vintage by Barbara within two (2) working days by email or in writing.
7.2 If products do not conform, Vintage by Barbara may either replace them after return or refund the purchase price.
7.3 As a private buyer, you have the right to return products within 14 days of delivery, provided that product and packaging are undamaged. Return costs are always borne by the buyer.

Article 8. Warranty

8.1 Vintage by Barbara is not obliged to provide more warranty than that which can be claimed from her suppliers.
Complaints about visible defects must be submitted within 14 days of receipt. For consumers, the term is fourteen (14) days. After this period, complaints may be refused. Refunds are processed within 14 days of correct return.

Article 9. Orders / communication

9.1 Vintage by Barbara is not liable for misunderstandings, delays or failures in communication caused by internet or other communication means, unless caused by intent or gross negligence.

Article 10. Force majeure

10.1 In case of force majeure, Vintage by Barbara may suspend or cancel orders without compensation.
10.2 Force majeure includes all shortcomings not attributable to Vintage by Barbara, as they are not her fault or responsibility under law or common practice.

Article 11. Miscellaneous

11.1 Orders are delivered to the address provided, unless another address is given in writing.
11.2 Any tolerance of deviations from these Terms does not affect the right to strict compliance later.
11.3 If any clause conflicts with applicable law, it will be replaced by a legally permissible equivalent provision.
11.4 Vintage by Barbara may use third parties in fulfilling orders.
11.5 All photos on the site are property of Vintage by Barbara. Use is only permitted with written consent.

Article 12. Governing law and jurisdiction

12.1 Belgian law applies to all offers, orders, agreements and these Terms.
12.2 All disputes will be submitted exclusively to the competent court in Mechelen.
